Gaming law and Gambling lawThe right to gamble is coordinated by general civil law, competition law and criminal law. It has been differently regulated in many countries. In Germany, it is important to consider the following laws from the German StGB (Strafgesetzbuch - Penal Code) §§ 284, 285, 286, 287 StGB as well as §§ §§ 657, 661, 661a from BGB (German Civil Code), the gambling state contract, §§ 3, 4 No. 5, 11 UWG must also be taken into consideration. The Gaming Ordinance regulates commercial gambling machines in gambling halls and restaurants as well as other games with profit possibilities. In Germany and the EU, strict rules on gambling law are applied. However, the ECJ's jurisprudence has also not led to alleviate the state-owned gambling monopoly in Germany, since some private gaming providers from other countries saw the freedom to provide services violated and this was not justified by the protection of minors. As a result, many private companies such as general gambling and betting companies are existing alongside state lotteries and similar.
