Patent Attorney in Germany

We are a law firm with our main office situated in Hanover. We are specialist in industrial property rights and we also employ patent attorneys. Our team of lawyers and patent attorneys collaborate in a unique work-environment, where we all complement each other. 

Definition and Synergies: Patent Attorneys and Lawyers

Our lawyers work on the whole legal aspect, having successfully pursued a degree in law, while our patent attorneys follow the practical aspect of the intellectual property protection. Moreover, our lawyers are specialized in the area of industrial property rights (patents, trademarks, designs, varieties and licenses). Not all lawyers are active in the area of technical protective rights: 75% of our attorneys are specialized in intellectual property law and have a prominent practical experience in the context of technical protective rights.

In order to become a patent attorney, a degree in natural science or technology is not essential, but an apprenticeship of min. 3 years in a Patent Attorneys Firm is fundamental; a subsequent examination has to be successfully achieved.

Range of activities of a Patent Attorney

Patent attorneys represent clients before the German Patent and Trademark Office, the Federal Patent Court in the area of Intellectual Property Rights and the Federal Court of Justice (BGH) in patent nullity appeal proceedings (§ 113 PatG).

Patent Attorney can represent also in civil procedures of ordinary legal proceedings, before the District Court, Higher Regional Courts and the BGH, as long as no lawyer coercion exists (e.g for an application for an interim injunction and for corresponding protection, but not for further proceedings). In such proceedings, however, a lawyer is usually the first choice and a patent attorney can eventually support the elaboration of the case in technical issues relating to the protection of the industrial/ intellectual property.

As a matter of fact, patent attorneys are comprehensively involved in inventions, technical and aesthetic innovations, trademarks, designs and know-how matters.

The range of activities of a patent attorney is as follows:

  • Consultancy on inventions, brands, design, know-hows, software protection, varietal protection, semiconductor lithography;
  • Registration of all industrial property rights (national and international);
  • Representation in proceedings before the German Patent and Trademark Office (DPMA), the Federal Patent Court (BPatG), the “Bundessorteamt” (BSortA), the European Patent Office (EPA, if allowed) and other international bodies of industrial property protection, as well as for particular cases (nullity proceedings) also before the Federal Court of Justice (BGH);
  • Monitoring and safeguarding of protective rights;
  • Defense of property rights, prosecution of infringements of property rights;
  • Consultancy and representation in matters regarding the Employee Invention Act;
  • Examination, preparation and consultation in connection with industrial property contracts (e.g. non-exclusive or exclusive licensing agreement, transfer agreement, intellectual property clause in M ​​& A contracts, etc.);
  • Researches on intellectual property rights;
  • Portfolio management and portfolio optimizations;
  • Strategic protection advices.
