Termination Agreement 

§ 1 Beendigung des Arbeitsvertrages

 Das zwischen der Firma _______ und Herrn/Frau _______ (im folgenden Mitarbeiter genannt) bestehende Arbeitsverhältnis wird hierdurch einvernehmlich mit Wirkung zum _______ aufgehoben. Anlaß für die Aufhebung ist die von der Firma dargelegte Notwendigkeit, betriebsbedingt das Arbeitsverhältnis beenden zu müssen. Bis zum genannten Tag wird die Vergütung in vollem Umfang bezahlt.

§ 1 Termination of the Employment Contract

 The employment relationship existing between the company _______ and Mr. / Mrs. _______ (hereinafter referred to as Employee) is thereby cancelled by mutual agreement with effect from _______. The reason for the annulment is the need for the company to terminate the employment relationship as a result of the actual operating condition. Until the above-mentioned date, the remuneration will be paid in full.

§ 2 Abfindung

 Der Mitarbeiter erhält wegen der Beendigung des Arbeitsverhältnisses in entsprechender Anwendung der §§ 9, 10 KSchG eine Sozialabfindung in Höhe von  _______ EUR, Die Abfindung ist am Tage der Beendigung des Arbeitsverhältnisses zur Zahlung fällig.

Würde dem Mitarbeiter im Falle einer betriebsbedingten Kündigung des Arbeitsverhältnisses ein höherer Abfindungsanspruch aus einem Sozialplan erwachsen, so bleibt ihm dieser Anspruch unter Verrechnung der Abfindung aus diesem Aufhebungsvertrag erhalten; das Datum dieses Aufhebungsvertrages gilt als Tag der Kündigung. 

§ 2 Severance Payment

 The employee receives a social compensation in the amount of _______ EUR due to the termination of the employment relationship in pursue §§ 9, 10 KSchG. The compensation is to be paid on the day of termination of the employment relationship.

If, in the event of an employment-related termination of employment, the employee were to receive a higher severance payment from a social plan, he shall remain entitled to this claim by offsetting the severance payment from this termination agreement; the date of this termination agreement is considered the date of termination.

 § 3 Urlaub

 Dem Mitarbeiter stehen für die Zeit bis zur Beendigung des Arbeitsverhältnisses noch _______ Arbeitstage Urlaub zu, der für die Zeit vom _______ bis _______ erteilt wird. Zwischen der Firma und dem Mitarbeiter besteht Einverständnis darüber, daß tatsächliche Voraussetzungen für weitere Urlaubs- oder Urlaubsabgeltungsansprüche nicht bestehen.

§ 3 Vacation

 The employee is entitled to _______ working days leave for the period from the _______ to _______ until the termination of the employment relationship. Company and employer agree on the fact that further conditions for further vacation or vacation compensation claims do not exist.

§ 4 Ausgleich aller Ansprüche

 Mit den oben bezeichneten Regelungen sind alle gegenseitigen Ansprüche der Firma und des Mitarbeiters aus dem Arbeitsverhältnis, gleichgültig auf welchem Rechtsgrunde sie im einzelnen beruhen mögen, vollständig abgegolten. Es bestehen auch keine tatsächlichen Gründe für einen Anspruch des Mitarbeiters auf Krankenlohn.

§ 4 Compensation of all Claims

 With the regulations described above, all mutual claims of the company and the employee from the employment relationship, irrespective of the legal grounds on which they may be based in detail, are fully compensated. There are no actual reasons for the employee's entitlement to sick pay.

§ 5 Vorbehalt

 Von der Ausgleichsklausel (§ 4) nicht erfaßt sind folgende Ansprüche:

  a) des Mitarbeiters:

 o auf Erteilung eines Zeugnisses;

o auf Dienstbefreiung zum Aufsuchen eines anderen Arbeitsverhältnisses;

o auf Zahlung von Karenzentschädigung;

o auf die betriebliche Altersversorgung;

 b) der Firma:

§ 5 Reservation

 The compensatory clause (§ 4) does not cover the following claims:

  a) of the employee:

 o on the issue of a reference;

o to be exempted from seeking another employment;

o on payment of compensation;

o on occupational pensions;
